TERMS OF SERVICE

These Terms of Service (“Terms”) govern access to and use of careidalert.com and purchases or use of products and services offered by CareID Alert (“CareID,” “we,” “us,” or “our”).
By visiting the website, placing an order, submitting information, activating a CareID product, or using a CareID service, you agree to these Terms and to the policies referenced in them.
1. CAREID SERVICES
CareID provides emergency-identification products and information-access services, including CareID Beacon, CareID Card, Digital CareID, CareID Vault, CareID Connect, condition-ready emergency guides, community guides, gift cards, and related support.
CareID products may use QR codes, NFC technology, links, hosted profiles, physical cards, labels, or other methods to help a bystander or first responder access selected emergency information.
CareID’s customer promise for core emergency access is: NO APP, NO SUBSCRIPTION, NO LOGIN.
2. NOT MEDICAL CARE OR EMERGENCY MONITORING
CareID is an emergency-identification and information-access system. It is not:
• A substitute for calling 911 or another local emergency service;
• A medical diagnosis or treatment service;
• A health care provider;
• An emergency monitoring, dispatch, or location-tracking service;
• A guarantee that a bystander or responder will notice, scan, tap, read, understand, or act on a CareID product; or
• A guarantee that internet, device, carrier, QR, NFC, wallet, hosting, battery, or network services will always be available.
Community and condition-ready guides provide general educational emergency-reference information. They are not individualized medical instructions.
A Personalized CareID may display customer-supplied information, but CareID does not independently diagnose conditions, prescribe treatment, or verify every fact submitted by a customer.
In an emergency, call 911 or the appropriate local emergency service.
3. ELIGIBILITY AND AUTHORITY
You must be legally able to enter into a binding agreement to purchase or manage a CareID product.
When ordering or submitting information for another person, you represent that you have that person’s permission or other appropriate legal authority, including parental or guardianship authority when applicable.
You are responsible for deciding what information is appropriate to place on a product or publicly accessible emergency profile.
4. CUSTOMER INFORMATION AND ACCURACY
You agree to provide complete, current, and accurate order, contact, personalization, and emergency-profile information.
You are responsible for reviewing proofs and correcting errors before approval. Approval authorizes CareID to prepare, print, program, activate, or deliver the approved product or profile.
You are responsible for keeping emergency contacts, medications, allergies, conditions, instructions, and other profile information current.
CareID may rely on information submitted and approved by the purchaser, profile owner, caregiver, parent, guardian, or authorized representative.
5. PUBLIC EMERGENCY-PROFILE ACCESS
CareID Connect is designed to make selected emergency information available without requiring a helper login.
Anyone who obtains the relevant QR code, NFC destination, link, permanent Digital CareID link, screenshot, or profile URL may be able to view, copy, photograph, or share the information displayed.
Search-engine controls, difficult-to-guess links, and other safeguards may reduce unintended discovery but do not make a publicly accessible emergency profile confidential.
Do not submit Social Security numbers, financial-account information, passwords, complete medical records, or information that is unnecessary for emergency use.
6. PERSONALIZED CAREID PROCESS
Personalized orders may require the customer to submit information after checkout.
CareID ordinarily prepares an initial proof within 1–2 business days after receiving complete information. Incomplete information, customer revisions, delayed responses, technical issues, or unusual requests may extend this estimate.
The customer must review and approve the proof before final activation or personalized production.
CareID may refuse or require revision of content that is unlawful, unsafe, misleading, abusive, technically unsuitable, excessively detailed, or inconsistent with the intended emergency purpose.
Customer-requested changes after approval may require additional production time, replacement costs, or service charges.
7. CONDITION-READY PRODUCTS
A Condition-Ready product provides general guidance associated with the selected condition. It does not automatically contain the individual’s name, medication list, emergency contacts, allergies, address, or individualized medical instructions.
Customers must not represent a Condition-Ready guide as a complete personal medical record.
8. QR, NFC, LINKS, AND DIGITAL ACCESS
QR and NFC components depend on compatible devices, readable surfaces, working cameras or NFC hardware, internet access, browser support, correct programming, and available hosting.
CareID may use a permanent resolver or redirect so that an assigned QR or NFC destination can be maintained or updated without replacing the printed code or NFC component. CareID does not guarantee that every third-party device will scan or tap successfully.
Do not alter, conceal, damage, overwrite, duplicate for unauthorized use, or redirect a CareID identifier.
9. ORDERS, PRICES, AND PAYMENT
Prices and availability may change before an order is accepted.
Taxes, shipping charges, discounts, and final totals are shown at checkout when applicable.
CareID may refuse, limit, or cancel an order for suspected fraud, pricing or catalog errors, unauthorized resale, technical problems, legal restrictions, inventory issues, or misuse.
When an order is canceled after payment, CareID will issue the refund required by applicable law and the Return and Refund Policy.
10. SHIPPING AND DELIVERY
Physical orders are governed by the Shipping Policy.
Delivery dates are estimates unless expressly guaranteed in writing. CareID is not responsible for carrier delays, weather, address errors supplied by the customer, theft after confirmed delivery, or other events beyond reasonable control, but CareID will provide reasonable support with a documented delivery issue.
Digital products and gift cards are delivered electronically and are not physically shipped.
11. RETURNS, REFUNDS, AND CANCELLATIONS
Returns, refunds, replacements, and cancellations are governed by the Return and Refund Policy.
Personalized, activated, and delivered digital products are subject to special restrictions because they are prepared for a specific person or delivered immediately.
Nothing in these Terms limits a right that cannot legally be waived.
12. GIFT CARDS
CareID gift cards may be used toward eligible purchases through CareID’s Shopify checkout.
Gift cards are not debit or credit cards and are not redeemable for cash except where required by law.
The purchaser is responsible for entering the correct recipient email address. CareID is not responsible for access by an unintended recipient caused by incorrect information supplied by the purchaser.
13. PRODUCT CARE AND REPLACEMENT
Customers must inspect products, keep QR and NFC areas clean and undamaged, test access periodically, and replace a product that becomes unreadable, detached, damaged, outdated, or unreliable.
Normal wear, misuse, unauthorized alteration, loss, theft, and damage after delivery are not manufacturing defects.
Any separate written warranty or replacement program applies according to its published terms.
14. ACCEPTABLE USE
You may not use CareID products, profiles, guides, website, or systems to:
• Impersonate another person;
• Publish information without appropriate permission;
• Harass, threaten, exploit, stalk, or endanger anyone;
• Commit fraud or misrepresent medical or emergency information;
• Introduce malicious code or attempt unauthorized access;
• Scrape, copy, reverse engineer, or interfere with the service;
• Redirect or duplicate an identifier for unauthorized purposes;
• Violate intellectual-property, privacy, publicity, consumer-protection, or other rights; or
• Violate applicable law.
CareID may suspend access, remove content, or cancel service when reasonably necessary to address misuse, safety, legal, or security concerns.
15. INTELLECTUAL PROPERTY
The CareID Alert name, product names, branding, designs, software, profiles, page layouts, graphics, guide structure, copy, and original content are owned by or licensed to CareID Alert and are protected by applicable intellectual-property laws.
You receive a limited, personal, non-exclusive right to use purchased CareID products and services for their intended purpose.
No ownership right is transferred except ownership of the physical product purchased.
16. CUSTOMER-SUPPLIED CONTENT
You retain rights you hold in information and content you submit.
You grant CareID a limited license to host, reproduce, format, display, transmit, print, and otherwise process that content only as reasonably necessary to fulfill, operate, maintain, support, secure, or improve the requested CareID product or service and to comply with law.
You represent that you have the rights and authority needed to provide the content.
17. THIRD-PARTY SERVICES
The storefront, checkout, payments, shipping, email, wallet, device, network, QR, NFC, and hosting experience may depend on third-party services, including Shopify.
Third-party services are governed by their own terms and policies. CareID is not responsible for a third party’s independent acts, outages, changes, or security practices.
18. DISCLAIMERS
To the fullest extent permitted by law, the website, products, guides, profiles, and services are provided on an “as is” and “as available” basis.
CareID does not warrant uninterrupted or error-free access, universal device compatibility, continuous internet or hosting availability, or a specific emergency outcome.
CareID does not warrant the accuracy of customer-supplied information.
These disclaimers do not exclude warranties or rights that cannot legally be excluded.
19. LIMITATION OF LIABILITY
To the fullest extent permitted by law, CareID Alert and its owners, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of data, loss of profits, emotional distress, or loss resulting from a person’s failure to notice, access, understand, or act on emergency information.
To the fullest extent permitted by law, CareID’s aggregate liability arising from a product, order, or service will not exceed the amount paid to CareID for the specific product, order, or service giving rise to the claim.
This limitation does not apply where liability cannot legally be limited, including liability resulting from conduct for which limitation is prohibited by applicable law.
20. INDEMNIFICATION
To the extent permitted by law, you agree to defend, indemnify, and hold CareID Alert harmless from third-party claims, losses, liabilities, and reasonable costs arising from:
• Information or content you submitted without appropriate rights or authority;
• Your misuse of a CareID product or service;
• Your violation of these Terms or applicable law; or
• Your negligent or wrongful conduct.
21. GOVERNING LAW
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent another law must apply.
Any dispute that is not required to be brought elsewhere by applicable law will be brought in a court of competent jurisdiction serving Orange County, Florida.
22. CHANGES
CareID may update these Terms to reflect changes in products, technology, law, or business practices.
The current version will display its effective date. Material changes will receive additional notice when required by law.
23. SEVERABILITY AND WAIVER
If a provision is found unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law.
Failure to enforce a provision is not a waiver of the right to enforce it later.
